What is Artwork Copyright in China

Artwork copyright in China protects original works of fine art, graphic design, and applied art under the Copyright Law of the People’s Republic of China. Article 3 of the law explicitly lists “works of fine art” (美术作品) as a protected category, which encompasses paintings, drawings, calligraphy, sculptures, graphic designs, product designs, packaging designs, logos, illustrations, and any other two-dimensional or three-dimensional artwork possessing originality and capable of being reproduced in a tangible form.

Copyright arises automatically upon the completion of an original work — registration is not mandatory for protection to exist. However, voluntary registration with the Copyright Protection Center of China (CPCC), the sole national-level institution authorized to administer copyright registrations, provides a government-issued certificate that serves as prima facie evidence of ownership. The registration certificate confirms ownership of artistic works and is extremely helpful in enforcement actions, administrative complaints, and civil litigation.

For foreign companies operating in or selling to China, registration is a critical business tool. E-commerce platforms such as Alibaba, JD.com, and Pinduoduo routinely request a Chinese copyright certificate before processing takedown complaints for counterfeit products that copy your packaging, logo, or product artwork. Without registration, foreign companies frequently find themselves unable to take swift action against infringers, a practice that hinders legal recourse.

⚖️ Important: Copyright protects the expression of creative ideas — the actual visual design — not the underlying concepts, styles, techniques, or functional features. Copyright registration is also distinct from trademark registration: a registered logo trademark protects brand identity linked to specific goods/services, while a copyright registration protects the logo as an artistic work across all categories with no goods limitation.

Types of Artwork Eligible for Protection

China’s copyright system protects a wide range of visual creative works. Any original design fixed in a tangible medium — whether digital or physical — is eligible for registration. The following are the most commercially significant categories for international businesses:

Logo Copyright Protection in China

Logo copyright registration is one of the most commercially valuable forms of artwork protection for foreign companies operating in China. While trademark registration protects your logo as a brand identifier within specific goods or service classes, copyright registration protects the logo as an artistic work across all 45 trademark classes simultaneously — with no goods limitation.

This cross-class protection is particularly powerful in China. If a bad-faith party registers your logo as a trademark in a class you have not yet filed in, a copyright registration certificate is prima facie evidence that can help convince examiners that the pirated logo should be refused registration. This strategy is widely used by international brands to combat trademark squatting — a common problem for foreign companies entering the Chinese market.

Any original logo design within the 50-year protection period is eligible for copyright registration in China. The certificate is immediately actionable: it can be used to file takedown complaints on e-commerce platforms (Alibaba IPP, JD.com, Pinduoduo), submit administrative enforcement petitions, record with China Customs to stop infringing exports, and support civil litigation. Critically, for a new logo that has not yet built market recognition, copyright registration provides the only immediate enforcement tool — trademark rights typically require proof of use or registration, while copyright protection exists from the moment the work is created.

UI Copyright Protection

User interface (UI) designs — including mobile app screens, software interfaces, menu layouts, dialog boxes, and interactive visual elements — can be protected under Chinese copyright law as works of fine art, provided they meet the originality threshold. Software interfaces with sufficient aesthetic and creative expression that demonstrate the author’s unique aesthetic choices in color, layout, graphics, and composition may qualify as protected artistic works.

However, UI copyright protection has important boundaries: copyright protects the visual expression of the interface — the specific arrangement of graphical elements, color schemes, icon designs, and screen layouts — but not the underlying functionality, operational procedures, or user experience flow. If a competitor copies only the functional workflow without replicating the visual design, copyright protection may not apply. Copyright also does not protect individual standard UI components (such as generic buttons or common menu structures) that lack sufficient originality.

For the strongest protection, we recommend a multi-layered IP strategy for UI designs:

Copyright Registration

Register core UI screens and icon sets as artistic works — the most direct way to prove ownership in infringement disputes. Retain complete design source files, version records, and public release evidence to support originality claims.

For interfaces with distinctive visual features, consider applying for a GUI design patent — this provides stronger, exclusive protection for up to 15 years, independent of copyright.

Anti-Unfair Competition Law

If your UI has gained market recognition and distinctiveness, imitative interfaces causing consumer confusion may be challenged under the Anti-Unfair Competition Law as “distinctive decoration” of goods or services.

Packaging Artwork Protection

Product packaging and decoration — including box designs, label artwork, wrapping patterns, container shapes, and decorative elements applied to product surfaces — can be protected under Chinese copyright law as artistic works, provided they possess sufficient originality. A work is entitled to copyright as soon as it is created, and registration provides the certificate needed for enforcement.

Copyright protection for packaging is particularly advantageous for products newly entering the China market that have not yet accumulated market popularity or brand recognition. Unlike trade dress protection under the Anti-Unfair Competition Law — which requires proof of “certain influence” and extensive market promotion — copyright protection is immediate and does not require proving market fame. Packaging that has just entered the China market can claim copyright protection from day one.

Required Documents

According to the China Copyright Protection Center, the following materials are required for artwork copyright registration. Foreign applicants are treated under the principle of national treatment — the required documents are the same as for Chinese citizens, with the additional requirement that all foreign-language documents must be accompanied by Chinese translations (except for work samples).

1 Registration Application Form Completed and signed online via the CPCC system. The form must be printed, hand-signed (or stamped with a company seal), and uploaded as a PDF scan. All fields must be filled in completely.
2 Applicant Identity Documents For companies: business license copy (notarized if foreign entity). For individuals: passport copy with Chinese translation. Foreign entities must provide proof of legal registration with at minimum: (1) institution name, (2) registration date, (3) place of registration, (4) registration certificate number, and (5) validity period.
3 Work Samples High-resolution digital images in JPG format (minimum 300 dpi) or color printed copies. For three-dimensional works (sculptures, packaging), submit images from multiple angles showing all sides. Each work must be uniquely named — duplicates are not permitted. Series works can be numbered sequentially.
4 Work Description Statement A written document explaining the creative concept, design process, key artistic features, and proof of independent creation. Must be written in Chinese and signed/stamped by the applicant with the application date.
5 Rights Assurance Statement A signed declaration confirming the work is original and does not infringe upon others’ rights. This is a mandatory document for all artwork copyright registrations.
6 Rights Ownership Proof (if applicable) Required for commissioned works, collaborative works, or employer-owned works. Includes: commissioned development contracts, collaboration agreements, or employment/assignment agreements clearly stating copyright ownership. Individual works do not require this document.

Once you receive the certificate — typically within approximately two months — you can immediately file takedown complaints through Alibaba’s IP Protection Platform (IPP), JD.com’s IP protection system, Pinduoduo’s IP protection portal, and 1688.com. The certificate is also valid for customs recordation, enabling border enforcement at China’s ports. What does artwork copyright NOT protect?

Artwork copyright protects the visual expression of creative works — the actual design, composition, and artistic elements.
