Pre-Application Strategy & Preparation

 China operates strictly on a “first-to-file” system (not “first-to-use”). File your application before market entry – ideally 12-18 months prior – to prevent opportunistic squatters

Don’t rely solely on your Western name/logo. Develop and register a meaningful Chinese character trademark (phonetic translation, semantic translation, or a combination) – this is critical for brand recognition and protection in the local market

Perform comprehensive clearance searches before filing. Use the China Trademark Office (CTMO) free online database initially, but seriously consider professional searches (covering identical AND highly similar marks in phonetics, appearance, and meaning) to minimize rejection risks

Accurately identify all relevant classes and sub-classes (goods/services) under the Nice Classification. Chinese examiners are strict; misclassification leads to gaps in protection. Remember: Fees are per class.

Your mark must be inherently distinctive or have acquired distinctiveness. Avoid:
